TERMS AND CONDITIONS FOR THE SALES AND PURCHASES OF GOODS AND OTHER SERVICES FROM REPTILESMALAYSIA.COM

REPTILESMALAYSIA RESERVES THE RIGHT TO UPDATE OR REVISE THESE TERMS AND CONDITIONS FROM TIME TO TIME. REPTILESMALAYSIA MAY GIVE NOTICE OF AMENDMENT(S) TO ITS CUSTOMERS IN SUCH A MANNER AS REPTILESMALAYSIA DEEMS APPROPRIATE. CONTINUATION IN THE REGISTRATION FOR MEMBERSHIP AND ACCEPTANCE OF THE GOODS FOR PURCHASE THROUGH THE PROFORMA INVOICE SIGNIFIES ACCEPTANCE BY CUSTOMERS OF CHANGES TO THESE TERMS AND CONDITIONS.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCEPTING THE SERVICE OR OFFER.

Sales of goods

  1. Upon placement of orders with ReptilesMalaysia, kindly serve the following information together with the orders:

    • Name
    • Date of Birth
    • Shop/premise’s address (For retailers and distributors only)
    • Shop/premise’s telephone number and fax number (For retailers and distributors only)
    • Importation License or CITES papers (as stipulated by the buyer’s local legislation) - For retailers and distributors only
    • Airport name and location. (For retailers and distributors only)
  2. After submission of the initial order from a buyer, a status check will be performed. Stocks ordered based on the buyer’s order will be reserved.
  3. After the status check, ReptilesMalaysia will send a finalised copy of the buyer’s sales order bearing ordered items, price per unit of items ordered, and the total price for the buyer’s confirmation. The buyer MUST confirm the order within 2 days or else the reservation of stocks will be released. Should the buyer disputes the finalised sales order, he/she should clearly point out the items in dispute and ReptilesMalaysia will re-run a stauts check again on those items. At this point, when the buyer confirms on the finalised sales order to ReptilesMalaysia, the confirmation will serve as consideration from the buyer to ReptilesMalaysia. As such, it creates the constructive obligation for the buyer to commit on the purchase. Once the final confirmation is received from the buyer, a proforma invoice will be sent to the buyer.
  4. Once the proforma invoice is sent, the buyer MUST prepay for goods ordered. All orders must be prepaid in full prior to any shipments made. Any late payments will result in the release of the reservation of goods ordered or potential delay of the shipment. This condition applies for buyers who nominates a WCA agent for payment. (kindly refer to Payment Methods below for details of payment methods stipulated)
  5. Upon receiving payment, ReptilesMalaysia will arrange for shipment of goods ordered. ReptilesMalaysia will be under contractual obligations to oversee the shipment until the shipment is loaded onto the plane. At this point, the risks and rewards will be transferred to the buyer and ReptilesMalaysia will be legally discharged from all responsibilities attached to the shipment. (kindly refer to Shipping terms below for details of shipping terms stipulated)
  6. Minimum order for any purchase is set at USD 3,000 for all countries other than the EU Eurozone. Minimum order for any purchase from the EU Eurozone is set at EUR 2,000.

Payment Terms and Methods

  1. All proforma invoice must be prepaid in full within 3 days from the date of receipt. ReptilesMalaysia reserves all rights to cancel all reservations and orders due to late payments.
  2. The buyer can either prepay through a wireless transfer or telegraphic transfer to our company’s account:

  3. The buyer can nominate a trusted WCA agent nearest to him/her and prepay the order in full to the WCA agent within 3 days after the sent date of the proforma invoice. Should the buyer opts this method, the following processes are to be observed:
    • Nominate a WCA agent and inform ReptilesMalaysia of agent’s details PRIOR to any payments made.
    • Subsequent to receiving further instructions from ReptilesMalaysia (2 working days), proceed payment to the nominated WCA agent within 3 days subsequent to the receipt of notification from ReptilesMalaysia.
    • Note : The WCA agent will not release the money to ReptilesMalaysia prior to the receiving of goods sent.
  4. Should the buyer bears the shipping expenses, a separate invoice will be sent subsequent to the arrangement of shipment. If these charges are not paid within 2 days upon receipt of the invoice, the shipment will be cancelled. Only half of the innitial prepayment will be refunded as penalty charges. (kindly refert to the shipping terms and methods for further details)
  5. In the event that the buyer is unable to locate a WCA agent, kindly inform ReptilesMalaysia UPON the confirmation of the finalised sales order and ReptilesMalaysia will assist the buyer in assigning one. Below are some agents from different countries for the buyer’s reference:

Shipping Terms and Methods

  1. Shipments for all orders will only be arranged when full payment for the proforma invoice is received. Subsequently, the buyer will be informed by ReptilesMalaysia on the arrangement of the shipment for ordered goods. ReptilesMalaysia reserves the right to cancel any shipment of goods due to late payments.
  2. In the event that the buyer should incur shipping and freight charges, these charges shall be fully paid by the buyer prior to any shipments of goods made. The buyer is required to settle payment within 2 days from the receipt of the separate invoice sent by ReptilesMalaysia. Should the buyer defaults or late payment observed, ReptilesMalaysia reserves the right to cancel the shipment. Consequently, there will be a penalty charged in which half of invoice value for the order prepaid will be forfeited.
  3. All orders that comply with the minimum order policy will be exempted from shipping and freight charges. Minimum order for any purchase is set at USD 3,000 for all countries other than the EU Eurozone. Minimum order for any purchase from the EU Eurozone is set at EUR 2,000.
  4. ReptilesMalaysia will ship goods whole year round. All shipments will only be sent out on Mondays to Thursdays. This is to avoid shipments reaching on weekends where unnecessary potential delays might occur. Should the buyer insists on ReptilesMalaysia sending the goods on Fridays to Sundays, the buyer will be responsible for any mishap due to delays in cargo clearance as a result of the buyer’s negligence and failure to excercise proper duty of care to receive the shipment in proper fashion. It is also the buyer’s responsibility to inform ReptilesMalaysia on whether the estimated time of arrival (ETA) will fall on a public holiday that will hinder the clearance process subsequent to receiving the shipment notice from ReptilesMalaysia. In case of any mortality that arise from the situations as mentioned above, the guarantee provided against DOA will be voided. (Kindly refer to Guarantee below for further details of the stipulated terms).
  5. Prior to shipments of any goods ordered, a copy of the airway bill and other detail instructions of the shipment will be forwarded to the buyer. Once the goods arrive at the destination airport, a WCA agent will perform the clearance process for the buyer. Should the buyer maintains a preferred agent to perform airport clearance, kindly inform ReptilesMalaysia prior to the shipment of goods. The buyer is expected to collect the goods within the stipulated time as detailed in the shipping instructions forwarded earlier from ReptilesMalaysia. Guarantee on the animals will be null and void once the collection of goods ordered is done after the insured coverage period.
  6. ReptilesMalaysia is contractually obligated to deliver goods as per ordered in good condition to the buyer subsequent to the receipt of payment from the buyer and also to oversee the fitness of the delivery of goods with due care until they are loaded onto the plane. The risks and rewards are transferred from ReptilesMalaysia to the buyer subsequent to the goods being loaded onto the plane. As such, ReptilesMalaysia has discharged itself contractually from all constructive and contractual obligations to the buyer and cannot be held responsible for any failures pertaining to the condition of goods shipped thereafter, due to negligence from parties external to ReptilesMalaysia.
  7. ReptilesMalaysia shall not be liable for any failure to perform its obligations where such failure is a result of Acts of Nature, war, terrorist activities, government sanction, blockage, embargo, strike, and no other Party will have a right to terminate this Agreement in such circumstances when the purchased goods are still in ReptilesMalaysia’s custody. Should the above mentioned force majeure occur, ReptilesMalaysia shall have the burden of proving that reasonable steps were taken to minimise delay or damages caused by forseeable events, that all non-excused obligations were substantially fulfilled, and that the buyer was timely notified of the likelihood or actual occurrence which would justify such an assertion, so that other prudent precautions could be contemplated.
  8. All shipments are packed under strict compliance with International Air Transport Association (IATA) and Airfreight Forwarders Association of Malaysia (AFAM) standards of live cargo packing.

Guarantee

  1. ReptilesMalaysia offers money-back guarantee to all animals sold against dead-on-arrival (DOA). Hence, all animals are guaranteed to reach the destination alive.
  2. Guarantee of the animals is valid from the point of goods being loaded onto the plane until the goods has been cleared from the plane. The buyer is expected to collect the goods within the stipulated time as detailed in the shipping instructions forwarded earlier from ReptilesMalaysia. Guarantee on the animals will be null and void once the collection of goods ordered is done after the insured coverage period.
  3. In the event that DOA does occur upon arrival, ReptilesMalaysia will reimbursed only 90% of the invoice value of the dead item(s). Reimbursement will only be made when the airport officials and/(or) WCA agent responsible for clearing the shipment acknowledge the Delivery Order from ReptilesMalaysia attached.
  4. Photographs of the dead animal(s) must be attached together with the receiving documents acknowledged by the parties mentioned above.(Photographs attached must contain the TOP view, RIGHT hand side view and LEFT hand side view of the dead animal.)
  5. Reimbursement will be made via wire transfer or direct debit into the buyer’s account.

Regional Order TabsTM(ROTsTM)

  1. To place an order in ROTsTM (hobbyist/retailer/distributor) , kindly follow the steps below:
    • Register the buyer’s name and email with ReptilesMalaysia prior to any orders made (for those who have not registered).
    • Subsequently, when making the first order (either through ROTsTM or a direct purchase from ReptilesMalaysia) , kindly submit the following details to ReptilesMalaysia together with your orders:
      • Name
      • Date of Birth
      • Shop/premise’s address (For retailers and distributors only)
      • Shop/premise’s telephone number and fax number (For retailers and distributors only)
      • Importation License or CITES papers (as stipulated by the buyer’s local legislation) - For retailers and distributors only
      • Airport name and location (For retailers and distributors only).
  2. Subsequently, you will be issued a status confirmation and also your ROTsTM Membership Number for future order references and your orders will be tabbed on your regional ROTsTM page on our web site.
  3. For future orders, kindly e-mail only your ROTsTM Membership Number and orders to sales@reptilesmalaysia.com.
  4. Once the ROTsTM of a particular region has been completed, the retailer/distributor must adhere to the terms and conditions as stipulated above.
